General Terms & Conditions for
"Cashback with QR code inside Grease Bucket scheme"

This ‘Cashback with QR code inside Grease Bucket scheme-Terms and Conditions’ (hereinafter referred to as “Terms and Conditions”, contains terms and conditions that constitute a legally binding agreement by and between, JCB India Limited, a company incorporated under the Indian Companies Act, 1956 (hereinafter referred to as the “Company“ or “we”) and each customer (which includes a purchaser /winner) (“You”, “you” or “user”) of the Cashback with QR code inside GreaseBucket scheme (“Program”).

THESE TERMS AND CONDITIONS CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND THE COMPANY.

BY PURCHASING THE GREASE PRODUCTS AS MENTIONED UNDER ANNEXURE-I AND THEREBY PARTICIPATING IN THE PROGRAM, YOU ARE DEEMED TO HAVE READ, ACCEPTED, EXECUTED AND AGREED TO BE BOUND BY THESE TERMS & CONDITIONS AND THE OTHER TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO ANY PROVISION OF THIS TERMS & CONDITIONS, YOU SHALL NOT PARTICIPATE IN THE PROGRAM IN ANY MANNER.

1. CASHBACK WITH QR CODE INSIDE GREASE BUCKET SCHEME

   1. The Company is pleased to announce the Cashback with QR code inside Grease Bucket scheme for customers purchasing the grease products as stipulated in Annexure-I (“Products”) wherein the customers shall be given certain gratification amount as elaborated herein below in this Terms & Conditions. The aforesaid Program shall be applicable and valid on purchase of the Products.

      Notwithstanding anything contained in this Terms and Conditions, the Cashback with QR code inside Grease Bucket scheme shall be subject to availability of the Products with the Company and / or its dealers and distributors.

   2. This Program is exclusively available to customers purchasing the Products until March 31, 2025 (“Program Applicability Period”)

   3. In terms of participating in the Program, the customer shall scan the QR Code printed on a coupon placed inside the respective grease buckets wherein the customer shall be re- directed to a web page requiring him/ her to validate their details inter alia their phone number, PIN Code, UPI ID, PAN etc. Upon, due verification of the details of the Customer, an instant gratification in the form of a pre-decided amount as provided under Annexure- II herein shall be transferred to the account of the customer linked with his / her UPI ID.

   4. It may be duly noted that successful entering in the Program and availing such gratification in connection thereto shall be subject to compliance with all requirements set forth in the gratification web page seeking information / personal information of the Customer. Upon, receipt of the gratification amount in line of the clause above, the customer’s screen shall mention the status of the transactions and the gratification amount along with total gratification received.

   5. It shall be duly noted that the customers shall have the option to contact the helpdesk on 8828027227, as mentioned on the coupon in case of any confusion / query with respect to remittance of the gratification amount. The help desk shall be operational during working hours (10.00 am to 6.00 pm) on weekdays i.e., Monday to Saturday.

   6. Any purchase of Products beyond the scope and Program Applicability Period shall not be governed by this Terms and Conditions and any such purchaser shall not have any rights and / or interests under the Program.

2. ASSUMPTIONS OF RISK

   1. General Assumptions of Risk:

      1. The Company will not undertake any liability and/or obligation for any loss of any kind whatsoever in relation to the aspects as stipulated herein in these Terms and Conditions.

      2. The Company will not undertake any liability and/or obligation for any loss of any kind whatsoever in relation to the aspects as stipulated herein in these Terms and Conditions.

      3. The Company will not undertake any liability and/or obligation for any loss of any kind whatsoever in relation to the aspects as stipulated herein in these Terms and Conditions.

      4. The Company will not undertake any liability and/or obligation for any loss of any kind whatsoever in relation to the aspects as stipulated herein in these Terms and Conditions.

3. AMENDMENT TO THIS TERMS AND CONDITIONS

   The Company reserves the right to amend these Terms and Conditions without any prior intimation to the participant / purchasers / customers.

4. PUBLIC ANNOUNCEMENT / ADVERTISMENT

   The Company reserves the right to feature / publicize any number of winners under the scheme on various media touch points as a part of its media campaign.

5. DISCLAIMER

   TO THE EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, WHETHER ARISING FROM OR RELATING TO THIS PROGRAM.

6. COMPLIANCE

   Each Party is solely responsible for making sure that their participation in this scheme is compliant with all laws, rules and regulations applicable to them.

7. MODIFICATION

   The Company reserves the right at any time to change, suspend, or discontinue the scheme in whole or in part with or without notice to the customers. You agree that the Company will not be liable to you for any such act.

8. TAX COMPLIANCE

   In the event the cumulative gratification amounts to more than INR 20,000/- in a financial year, the same shall be subjected to 10% TDS deduction in terms of Section 194R of the Income Tax Act, 1961. Further, the customer agree that it shall be solely liable for determining what, if any, taxes apply to your transactions, as per the applicable laws of any country in which you are residing or are situated. Neither the Company nor any other Third Party is responsible for determining the taxes that may apply to your transactions.

9. DISPUTE RESOLUTION

   In the event of any dispute, all rights and obligations with respect to this Terms and Conditions shall be governed and construed in accordance with the laws of India and the courts at New Delhi, India shall have the jurisdiction to determine any and all such disputes.

10. MISCELLANEOUS

    1. Waiver: The remedies herein reserved shall be cumulative, and in addition to any other remedies provided at law or equity. Any failure by the Company to enforce or insist upon strict compliance with any provision of these Terms shall not be deemed to constitute a waiver of rights to demand strict compliance with the terms hereof. No waiver of any term or condition of these Terms shall be deemed or construed to be a waiver of any subsequent such term or condition in the future.

    2. Severability: Each of the provision of these Terms is separate and severable from the other. Any provision which is invalid or unenforceable, shall be ineffective to the extent of such invalidity or unenforceability, without affecting in any way the remaining provisions hereof.

    3. Entire Agreement: These Terms and the terms and conditions set out in these Platform Terms by reference, constitute the entire agreement between the user and the Company with respect to the subject matter hereof.
